Terms of Service
Effective date: April 8, 2026
These terms cover the Showpane hosted services at showpane.com and app.showpane.com. The open-source portal application is licensed separately under the AGPL-3.0 license, and the skill pack under the MIT license. If you have a signed agreement with us, that agreement takes precedence.
1. Acceptance and Scope
By using Showpane (“we,” “us,” or “our”) websites, Cloud platform, CLI tools, APIs, or support channels (the “Services”), you agree to these Terms. Our Privacy Policy is incorporated by reference.
2. Eligibility and Accounts
You must have the legal capacity to enter into a binding agreement. You are responsible for maintaining accurate account information, securing your credentials, and all activity under your account. Notify us immediately if you suspect unauthorized access.
If you create an organization account, administrators are responsible for managing member access, roles, and activity within the organization.
3. Plans, Billing, and Subscriptions
- Self-hosted (free) — deploy on your own infrastructure with no usage limits or fees
- Cloud ($29/month) — hosted portals, engagement analytics, team access, managed infrastructure
Cloud subscriptions are billed monthly via Stripe with automatic renewal until canceled. New Cloud subscriptions include a 7-day free trial with a valid payment method required. Fees are non-refundable. You are responsible for any applicable taxes.
We may offer promotional pricing or trials at our discretion, which may be modified or discontinued at any time.
4. Your Content and Data
You retain ownership of all content you create through the Services, including portal pages, uploaded files, and client data. You grant us a limited license to host, store, and transmit your content solely to provide the Services.
For self-hosted deployments, your data remains entirely on your infrastructure. For Cloud deployments, your data is stored in our database and hosting providers as described in our Privacy Policy.
You are responsible for ensuring you have the right to use and share all content you upload, and for maintaining your own backups.
5. Engagement Analytics
Cloud plans include engagement tracking features that collect visitor activity data (page views, section time, document views) on your portals. This data is collected using first-party cookies with no personally identifiable information. You are responsible for informing your clients about analytics collection where required by applicable law.
6. Acceptable Use
You agree not to:
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to the Services or other accounts
- Use the Services for spam, phishing, or deceptive practices
- Infringe on intellectual property rights
- Circumvent billing, rate limits, or usage restrictions
- Share account credentials with unauthorized parties
- Interfere with or disrupt the Services or infrastructure
7. API Keys and CLI Tokens
CLI access tokens and API credentials are confidential. You are responsible for all activity performed using your tokens until you report a compromise and the token is revoked. We may revoke or rotate tokens at any time for security, abuse, or legal reasons.
8. Third-Party Services
The Services integrate with third-party providers including Clerk (authentication), Stripe (payments), Supabase (database), Vercel (hosting), and Resend (email). Your use of these services is subject to their respective terms. The open-source portal application uses dependencies governed by their own licenses.
9. Suspension, Cancellation, and Data Lifecycle
We may suspend or terminate your access for violations of these Terms, non-payment, security concerns, or legal requirements.
You may cancel your Cloud subscription at any time. Your portals remain accessible until the end of the current billing period. After cancellation:
- Portal deployments are taken offline
- Data is retained for 90 days
- After 90 days, all data (Vercel projects, database records, uploaded files) is permanently deleted
You are responsible for exporting your data before the retention period ends.
10. Service Changes and Availability
We may modify, add, or remove features at any time. We do not guarantee specific uptime or availability unless stated in a separate written agreement. Beta or preview features are provided “as is” without warranty.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability is limited to the greater of the fees you paid us in the 12 months preceding the claim or $100.
13. Indemnification
You agree to defend and indemnify us against any claims, damages, or expenses arising from your content, your use of the Services, or your violation of these Terms or applicable law.
14. Changes to These Terms
We may update these Terms from time to time. We will update the effective date and notify you of material changes via email or in-product notice. Continued use of the Services after changes take effect constitutes acceptance.
